Terms of service

Last updated: 2026-10-20

1. Acceptance of terms

These Terms form a binding agreement between you and Plan and Pixel LLC (“Plan and Pixel”, “we”, “us”), which operates the Plate 8 platform, website, mobile apps, and related services (together, the “Service”). By creating an account, signing an order form, or using the Service, you accept these Terms. You must be at least 18 years old and authorised to bind your restaurant or company.

2. Your account

You are responsible for keeping your login credentials confidential and for every action taken under your account. Tell us at hello@plate8.io without delay if you suspect unauthorised use, a credential leak, or a security incident. Plan and Pixel is not liable for losses arising from your failure to protect your credentials or your failure to report misuse in time.

3. Fees and payment

Fees, billing cycle, and payment terms are set in your order form or subscription plan. Unless Indian law requires otherwise, fees are non-refundable. All amounts are exclusive of GST and other applicable taxes, which will be added at the prevailing rate. Payment is handled through RBI-regulated payment aggregators. We may change pricing on 30 days’ prior notice; continued use of the Service after the notice period counts as acceptance of the new pricing.

4. Your content and operational data

You own the data you put into Plate 8 — POS sync data, voice recordings, bill images, OCR output, inventory counts, recipe BOM, store roster, supplier records, menu, and sales (“Customer Data”). You grant Plan and Pixel a limited, non-exclusive, worldwide licence to host, process, transmit, display, and derive insights from Customer Data strictly to run and improve the Service for you. We do not sell Customer Data. We may use de-identified and aggregated information — numbers that cannot reasonably be linked back to you, your staff, or your suppliers — to run benchmarks and improve product features.

5. Messaging (WhatsApp, SMS, email)

Plate 8 sends purchase orders, reminders, roster updates, and related operational messages to suppliers and staff on your instruction. Suppliers and staff must opt in directly — through a Plate 8 opt-in link, a signed onboarding form, or an SMS/WhatsApp keyword — before any message is sent. You may invite a contact to opt in, but you may not consent on their behalf. Recipients can opt out at any time by replying STOP (on SMS) or using the WhatsApp stop/block controls. Message frequency varies with your activity and standard carrier rates may apply to the recipient. Supplier and staff data is not used for marketing by Plan and Pixel. You agree to use Plate 8 messaging only for legitimate business communication with your own suppliers and staff, and to comply with TRAI commercial communication regulations, WhatsApp Business policy, the DPDP Act, and the IT Act.

6. Prohibited uses

You may not:

  • use the Service in breach of Indian law, including the IT Act, DPDP Act, TRAI rules, or RBI/GST obligations;
  • send spam, unsolicited marketing, or non-compliant commercial communication through Plate 8;
  • reverse engineer, decompile, or try to extract the source code, model weights, or training data of the Service;
  • probe, scan, or disrupt the Service, or try to break authentication or rate limits;
  • access or try to access another workspace or user account without authorisation;
  • upload malware, pirated content, or any content that infringes a third party’s rights;
  • resell, sublicense, or share Plate 8 access outside your subscribed workspace;
  • enter false, forged, or deliberately misleading operational data — including fake invoices, inflated counts, or fabricated roster entries — into the platform.

7. Intellectual property

Plan and Pixel owns the Service, including the Plate 8 software, APIs, speech and OCR models, forecasting algorithms, interfaces, documentation, and brand marks. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service during your paid subscription term. You may not copy, modify, distribute, publicly display, create derivative works from, or use the Service to build a competing product.

8. Privacy

Your use of the Service is also governed by the Plate 8 Privacy Policy, which forms part of these Terms. By using the Service you confirm you have read it and accept it.

9. Disclaimer of warranties

The Service is provided on an “as is” and “as available” basis, to the maximum extent allowed by law and without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We do not warrant the accuracy of AI-generated output, including voice transcription, OCR line items, variance calculations, or demand forecasts, and you remain responsible for reviewing them before acting. We do not guarantee successful delivery of every WhatsApp, SMS, or email message routed through third-party carriers and aggregators.

10. Limitation of liability

To the maximum extent allowed under Indian law, Plan and Pixel is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost or corrupted data, stock-outs, inventory spoilage, over-ordering, under-ordering, or the cost of substitute goods or services. Our aggregate liability for all claims arising out of or related to the Service is capped at the fees you actually paid to Plan and Pixel in the twelve months immediately before the event giving rise to the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless Plan and Pixel, its directors, employees, and contractors against any claim, demand, loss, or expense (including reasonable legal fees) arising from: your use of the Service; your breach of these Terms or any Indian law; your failure to collect valid consent before messaging a supplier or staff member; the content of any message you direct Plate 8 to send; or any third-party claim relating to messages, operational data, or recordings you submitted.

12. Termination

Either party may terminate the subscription on 30 days’ written notice to the other. Plan and Pixel may suspend or terminate the Service immediately if you materially breach these Terms, fail to pay, or create a legal, security, or reputational risk. For 30 days after termination you may export your Customer Data through the in-app export tools or by writing to hello@plate8.io. Sections 4, 7, 9, 10, and 11 survive termination.

13. Referral programme

Plate 8 runs an optional referral programme for existing customers and partners. By participating, you agree to the following:

  • Eligibility. You must be 18+ and resident in India. Plan and Pixel employees, contractors, and self-referrals do not qualify.
  • Qualifying referrals. The referred restaurant must be new to Plate 8, with no existing account, trial, or active commercial discussion. Plan and Pixel decides attribution in its sole discretion.
  • One reward per customer. We pay one reward per referred customer, even if the customer later opens multiple outlets, franchises, or linked workspaces.
  • Rewards. For each qualifying referral you may choose one of: INR 25,000 as a UPI transfer or a prepaid card; or a curated kitchen hardware bundle of equivalent value shipped within India. Choices are final. If no selection is made within 30 days of becoming eligible, the UPI/prepaid-card option is issued by default.
  • Fulfilment. The prepaid card is issued by an RBI-regulated prepaid instrument issuer. Hardware bundles are shipped by our logistics partner and require a valid shipping address within India within 60 days. Plan and Pixel is not the manufacturer and makes no warranty beyond those passed through by the original brand.
  • Substitution. We may substitute a comparable item or issue the cash-equivalent UPI transfer if an item is unavailable.
  • Earning. A reward is earned only once the referred restaurant has been live and in paid status on Plate 8 for 30 consecutive days.
  • Taxes. You are responsible for income tax, TDS where applicable, and any GST on rewards. We may ask for PAN details and issue Form 16A or other certificates.
  • Conduct and changes. Spam, fraud, trademark bidding on “Plate 8” or “Plan and Pixel”, or any misrepresentation voids the reward. We may change or end the programme at any time.

14. Governing law and dispute resolution

These Terms are governed by the laws of India. You first agree to raise any dispute informally with us at hello@plate8.io. If a dispute is not resolved within 30 days, it will be submitted to the exclusive jurisdiction of the competent courts at Mumbai, Maharashtra, except that either party may seek urgent interim relief in any court of competent jurisdiction.

15. Contact us
